Seminar: Addressing Restriction in Australian Aged Care Facilities

If you live in Adelaide, or can travel here, and are interested in the regulation of detention, and other restrictive practices in aged care facilities in Australia, you will be interested in the following seminar, being hosted by the Law School at the University of Adelaide.

I’m very pleased to be invited, to present on the Dementia Justice: Dementia Redress Project recently completed by Professor Linda Steele from UTS and myself on exploring the need for redress and reparations in response to violence, abuse and neglect of people living with dementia in residential aged care in Australia.

Seminar: Addressing Restriction in Australian Aged Care Facilities

Date: 17 April 2023, 5:30-7PM

Venue: Moot Court, Adelaide Law School (Ligertwood Building), North Terrace

The last few years have seen significant impacts on the regulation of detention and other restrictive practices in aged care facilities. Four years ago, the South Australian Supreme Court found that special orders would be required to detain a person under guardianship in a locked ward, and the early 2020s have been characterised by the introduction of new rules around behaviour support plans (now applicable to both NDIS and aged care) and a Senior Practitioner scheme for the monitoring of restrictive practices (only NDIS so far).

To make sense of these developments and their consequences from a range of perspectives, we are pleased to invite you to the following seminar:

Our presenters are:

  • Dr Esther Erlings (Macquarie University) – The legal aspects of detention and restriction.
  • Ms Carolanne Barkla (Chief Executive of Aged Rights Advocacy Service Inc (ARAS)) – Advocacy for persons experiencing restrictions.
  • Ms Kate Swaffer (PhD Candidate, University of SA; Co-founder of Dementia Alliance International) – Reparation for harm caused in aged care.
  • A/Prof Laura Grenfell (University of Adelaide) – Human Rights and the Royal Commission into Aged Care.

The presentations will be followed by discussion and Q&A.

We welcome walk-in participants on the day, but, if possible, please RSVP by sending an e-mail to esther.erlings@mq.edu.au or laura.grenfell@adelaide.edu.au.

We look forward to seeing you at the seminar!
